THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

 

1. Our Commitment to Your Child's Privacy

Imagination ABA Therapy LLC ("Imagination ABA," "we," "us," or "our") is required by law to protect your child's protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA) and applicable New Jersey state laws. When federal and New Jersey law differ, we follow whichever standard gives your child's information greater protection.

We are required by law to:
• Maintain the privacy and security of your child's PHI
• Give you this Notice of our legal duties and privacy practices
• Follow the terms of the Notice currently in effect
• Notify you promptly if a breach occurs that may have compromised the privacy or security of your child's information

 

2. How We May Use and Share Your Child's Health Information

Treatment — To provide, coordinate, and manage your child's ABA services, including communicating with your child's other providers when needed.

Payment — To bill and collect payment from your insurance provider or other payer.

Healthcare Operations — For quality improvement, supervision, training, licensing, credentialing, and internal audits.

 

3. Other Uses and Disclosures Permitted or Required by Law

We may share your child's information without your written authorization only when the law permits or requires it, such as:
• Reporting suspected child abuse or neglect, as required by New Jersey law
• Preventing or lessening a serious and imminent threat to health or safety
• Responding to a court order, subpoena, or other lawful process
• Public health activities and health oversight audits or investigations
• Workers' compensation, law enforcement, or other purposes required by federal or state law

 

4. Uses That Require Your Written Authorization

We will not use or share your child's information for any other purpose without your written authorization, including:
• Marketing purposes
• Sale of your child's information
• Most sharing of psychotherapy notes

You may revoke an authorization in writing at any time. Revocation applies to future disclosures only.

 

5. New Jersey State Protections

Per N.J.A.C. 10:37-6.79, additional protections apply to mental health records. N.J.S.A. 26:2B-1 confidentiality protections apply to substance use disorder records where relevant.

 

6. Your Rights

You have the right to:
• Access your child's PHI and request a copy, including an electronic copy. We may charge a reasonable, cost-based fee.
• Request amendments to your child's records if you believe they are incorrect or incomplete
• Request restrictions on certain uses or disclosures. If you pay for a service in full out of pocket, you may ask us not to share information about that service with your health plan, and we will agree unless the law requires us to share it.
• Request confidential communications, such as contacting you at a different phone number or address
• Receive an accounting of certain disclosures we have made
• Receive a paper copy of this Notice at any time, even if you agreed to receive it electronically
• Choose someone to act for you, such as a legal guardian

 

7. Complaints

If you believe your child's privacy rights have been violated, you may file a complaint with us using the contact information below, or with the U.S. Department of Health and Human Services, Office for Civil Rights, at www.hhs.gov/ocr/complaints, 1-877-696-6775, or 200 Independence Avenue S.W., Washington, D.C. 20201. We will not retaliate against you for filing a complaint.

8. Changes to This Notice

We may change the terms of this Notice, and the changes will apply to all information we have about your child. The current Notice is always available on our website and from our office.
